For the purposes of these General Terms and Conditions, "consumer" means any natural person who concludes a legal transaction for purposes that cannot predominantly be attributed to his or her commercial or self-employed professional activity.

Definitions

In these General Terms and Conditions (hereinafter the "Terms") the following definitions apply:

Agreement: any sales agreement concerning products that is concluded between the Seller and the Buyer through the online store at www.lumevre.com.

Article 2. Applicability

2.1 These Terms apply to every offer made by the Seller and to every Agreement concluded between the Seller and the Buyer.

2.2 Before the Agreement is concluded, the text of these Terms is made available to the Buyer via the website. If this is not reasonably possible, the Seller will indicate how the Terms can be viewed.

2.3 By placing an order, the Buyer declares to have read these Terms and to agree to them.

2.4 Deviations from and additions to these Terms are only valid if they have been expressly agreed in writing between the Seller and the Buyer.

2.5 Any purchasing conditions or other terms of the Buyer are expressly rejected.

Article 3. The offer

3.1 Every offer made by the Seller is non-binding. The Seller has the right to change and adjust the offer.

3.2 The offer contains a complete and accurate description of the products offered. Obvious mistakes or errors in the offer do not bind the Seller.

3.3 All images and specifications on the website are presented as accurately as possible. Minor deviations in colour, dimensions or finish resulting from the production process or from how images are displayed on screen are not regarded as a defect and do not entitle the Buyer to rescind the Agreement or to claim damages.

Article 4. Conclusion of the Agreement

4.1 The Agreement is concluded at the moment the Buyer accepts the offer and has met the conditions attached to it.

4.2 The Seller confirms receipt of the acceptance of the offer electronically. As long as the Seller has not confirmed receipt of this acceptance, the Buyer may revoke the Agreement.

4.3 The Seller has the right to refuse an order or to request additional information if this is considered necessary for the correct processing of the order.

Article 5. Prices and payment

5.1 All prices stated are in euros and include VAT, unless expressly stated otherwise.

5.2 The Seller reserves the right to change prices. The price that applies at the moment the Agreement is concluded is decisive.

5.3 Payment is made using the payment methods offered at checkout, such as iDEAL | Wero, credit card, Apple Pay, Google Pay, Klarna and PayPal. Payments are processed via Shopify Payments or by the relevant payment service provider, subject to their own terms.

5.4 Orders are paid for in advance when the order is completed. Should a payment be reversed, refused or cancelled afterwards for any reason, the Buyer remains liable for the full amount. In that case the Seller has the right to suspend delivery or to rescind the Agreement, and to recover any resulting damage from the Buyer.

5.5 Orders are only processed after successful payment.

Article 6. Delivery

6.1 The Seller delivers within the Netherlands, to Belgium and to Germany.

6.2 Shipping within the Netherlands is free of charge. Shipping to Belgium or Germany costs €9.95, or is free for orders over €99, as stated in the shipping policy at the time of ordering. The Seller is entitled at any time to change the shipping costs and the conditions attached to them, including increasing or reducing rates, and introducing, adjusting or ending reduced shipping costs or shipping promotions. Changes apply to orders placed after the moment of the change and do not affect orders that have already been placed.

6.3 The Seller ships an order within two business days of payment confirmation. The expected delivery time is 2 to 3 business days within the Netherlands and 3 to 5 business days for Belgium and Germany, in each case after confirmation of payment, unless stated otherwise on the website or in the order confirmation.

6.4 The delivery times stated are indicative. Exceeding a delivery time does not entitle the Buyer to compensation, unless there is intent or gross negligence on the part of the Seller.

6.5 Orders consisting of multiple products are in principle shipped together in a single shipment. The Seller reserves the right to split the order into multiple parcels if the size, weight or fragility of the products reasonably does not allow combined shipping.

6.6 The risk of damage and/or loss of products remains with the Seller until the moment of delivery to the Buyer, unless expressly agreed otherwise.

6.7 Collection in person is not possible. Returns by personal handover are not possible either. Returns take place exclusively by parcel shipment.

Article 7. Right of withdrawal

7.1 The Consumer has the right to withdraw from the Agreement, without giving reasons, within a withdrawal period of 14 days. This period starts on the day after the Consumer has received the Product.

7.2 The Consumer exercises the right of withdrawal by notifying the Seller by e-mail at contact@lumevre.com within the withdrawal period, stating the order number. The Consumer may use the model withdrawal form below for this purpose, but is not obliged to do so.

7.3 The Product must be returned within 14 days after the notification referred to in Article 7.2, unused, undamaged and in its original packaging.

7.4 The costs of the return shipment are borne by the Consumer, unless the Product was damaged or was delivered incorrectly.

7.5 The Seller refunds the full purchase amount, including the original shipping costs paid by the Consumer when ordering, within 5 business days of receiving the returned shipment, provided the Product meets the conditions set out in Article 7.3. The refund is made using the same payment method that was used for the original transaction, unless expressly agreed otherwise.

7.6 The right of withdrawal does not apply to products that have been personalised or customised at the request of the Buyer.

Article 8. Mounting, use and liability

8.1 The Seller's products are intended exclusively for decorative use as an indoor wall object. Use outside buildings or in humid rooms is not recommended.

8.2 The Buyer is responsible for fixing the Product to the wall correctly. The Seller recommends using a wall plug and a screw that are suitable for the wall material in question and for the weight of the Product, in line with the enclosed mounting instructions.

8.3 The Seller is not liable for personal injury or material damage resulting from incorrect mounting, insufficient load-bearing capacity of the wall, the use of unsuitable fixings or any other improper use of the Product.

8.4 The Seller's liability for material damage or financial loss is in all cases limited to the amount the Buyer paid for the Product concerned. The Seller is never liable for indirect damage, consequential damage or loss of profit.

8.5 The limitation referred to in Article 8.4 does not apply to liability for death or personal injury resulting from a fault of the Seller.

8.6 The limitations in this Article do not apply if the damage is attributable to intent or conscious recklessness on the part of the Seller.

Article 9. Warranty and complaints

9.1 The Seller warrants the soundness of the products supplied and guarantees that they conform to the specifications stated in the offer. Due to the high-gloss, hand-polished finish of the Product, very fine polishing lines may be visible. This is inherent in the production process and is not regarded as a defect.

9.2 Please report damage that occurred during delivery, and incorrect deliveries, by e-mail to contact@lumevre.com, preferably within 48 hours of receipt, stating your order number and including photos of the product and the packaging. This allows us to resolve the damage quickly with the carrier. Report other defects within a reasonable time after you discover them.

9.3 The Seller investigates the complaint and, within reason, offers a suitable solution in the form of a replacement product, compensation, or a full or partial refund of the purchase price.

9.4 Your statutory rights in respect of defects remain unaffected in all cases, including if you make a report after the period referred to in Article 9.2.

Article 10. Copyright and rights of use

10.1 All content of the website www.lumevre.com, including texts, images, photographs, illustrations, logos and software (hereinafter "content"), is protected by copyright and is the property of the Seller or its licensors.

10.2 Downloading or using the content for private, non-commercial purposes is permitted. Any further publication, transfer, reproduction or other use of the content requires the Seller's prior express written permission.

10.3 All trademarks and signs used on the website may not be used without the Seller's prior written permission.

Article 11. Disclaimer of liability for hyperlinks

Insofar as the website www.lumevre.com links to websites of other providers, the Seller has no influence over their content, does not adopt it as its own and accepts no warranty or liability for it. The respective provider or operator of such pages is always responsible for their content. As soon as the Seller becomes aware of legal infringements on linked websites, the hyperlink concerned is removed immediately.

Article 12. Data protection

12.1 The Seller processes the Buyer's personal data solely for the performance of the Agreement and the handling of orders, in accordance with applicable data protection legislation (GDPR).

12.2 Personal data is not passed on to third parties unless this is necessary for the performance of the Agreement, such as passing it on to the carrier for delivery.

12.3 For more information about the processing of personal data, including the use of marketing cookies and the sharing of data with third parties such as Meta, the Seller refers to its privacy policy.

Article 13. Force majeure

13.1 The Seller is not obliged to perform any obligation towards the Buyer if the Seller is prevented from doing so by force majeure. Force majeure includes, among other things: disruptions at suppliers or transport companies, government measures, extreme weather conditions and other circumstances beyond the Seller's reasonable control.

13.2 If a situation of force majeure lasts longer than 30 days, either party has the right to rescind the Agreement in writing, without any right to compensation arising.

Article 14. Dispute resolution

14.1 The Seller is neither obliged nor willing to participate in dispute resolution proceedings before a consumer dispute resolution body.

14.2 Without prejudice to the above, you can contact the Seller directly about complaints at any time via contact@lumevre.com.

Article 15. Amendments to these Terms

The Seller reserves the right to amend these Terms, for example in the event of new legislation or changes in business practice. For any order, the Terms that were published on the website at the time of the order apply.

Article 16. Governing law and competent court

16.1 Dutch law exclusively applies to all agreements between the Seller and the Buyer.

16.2 All disputes arising from or relating to the Agreement will be submitted exclusively to the competent court in the district of Oost-Brabant, the Netherlands, without prejudice to the Consumer's right to submit a dispute to the court of his or her place of residence.

16.3 Before submitting a dispute to the court, both parties will attempt to resolve the dispute through mutual consultation.
